Prop 65 Tiffany Lamp LitigationThe Ecological Rights Foundation has filed seven lawsuits in San Francisco alleging that persons who touch the solder in Tiffany-style lamps and other stained glass products are exposed to lead. Three of the cases have been settled, with consent judgments calling for sliding payments based on the defendants' ability to reformulate to "lead free" (99.996% lead free) solder. Prior "opt-in" provisions in the settlements were removed, but ERF has apparently agreed with the settling defendants not to settle with any other parties on any better terms. On January 10, 2001 the San Francisco Superior Court ordered all pending Tiffany Lamps cases consolidated for all purposes, over the objection of plaintiff. Tiffany Lamp Litigation SettlesIn June 2001, a consent judgment incorporating a settlement between a number of manufacturers of Tiffany style lamps and the ERF was entered in the consolidated litigation in San Francisco Superior Court. The manufacturers in Ecological Rights Foundation v. Cheyenne Industries, etc., agreed to reformulate their lamps to remove lead from the solder in excess of 0.00%, and to make settlement payments of $100,000 for public interest purposes and $100,000 in attorney's fees to ERF.
