1996AB 3160 Dies in AssemblyOn May 31, 1996, AB 3160 was voted down in the California Assembly, 38-38. The bill would have provided that the Attorney General could, in his discretion, declare a proposed private Prop 65 enforcement action to be contrary to the public interest, if he determined that the action was frivolous or without merit, the violation(s) alleged were de minimis, or where the 60 day notice was deemed insufficient. By the terms of Prop 65, AB 3160 required a 2/3 majority in both houses of the Legislature. It was supported by various industry groups and was sponsored by the Atttorney General's office. A number of environmental organizations opposed the bill, including the Environmental Defense Fund and EDF counsel David Roe, one of the drafters of Prop 65.
